Was Sie wissen sollten
Im Erbfall geht der Nachlass entweder ganz oder in Teilen auf eine oder mehrere Erben über gemäß § 1922 Abs.1 BGB über. Der Erbe tritt die gesetzlich vorgeschriebene Gesamtrechtsnachfolge an. Ein bestellter Erbe wird mit diesem Antritt nicht nur der neue Inhaber aller Vermögensgegenstände und Rechte, sondern übernimmt auch alle Verpflichtungen des Verstorbenen, d.h. der Erbe erbt auch alle Schulden des Erblassers.
Das Recht Erbe zu sein, kann sich aus einer Anordnung des Erblassers (Verstorbenen) aufgrund einer letztwilligen Verfügung, wie z.B. dem Testament oder wenn keine Letztwillige Verfügung vorliegt, aus der vom Gesetzgeber vorgeschriebenen Erbfolge (gesetzliche Erbfolge) ergeben.
Ist man sich sicher, dass der Nachlass nicht überschuldet ist, sollte man das Erbe annehmen. Um dann seine Erbenstellung nachweisen zu können, wird in der Regel ein Erbschein benötigt.
